With the volume of traffic on our streets and highways, it is not surprising that there are problems: traffic jams, flared tempers, minor accidents. Most of this does not result in a lawsuit.
But sometimes a person dealing with this every-day nuisance is caught up in a more significant event: he or she is injured in an auto accident. Then it is time to decide how to proceed. No one wants to get involved in litigation; but sometimes there is no reasonable alternative.
There are credible sources that advocate handling your own personal injury case. In fact, I have advised potential clients to handle their own cases myself. However, each one has later come back and retained me to represent them once they tried to sort through the morass themselves.
For those unfamiliar with the process, here is a summary of what could happen in a personal injury case.
- Following the accident, the driver at fault may offer you cash to settle all claims. This sounds good at first, but is very dangerous and unwise. Auto accidents can have long-range effects and many times serious injuries do not appear for days, weeks, or even months later. Accepting a quick settlement is never a good idea.
- The at-fault person’s insurance company will almost certainly offer to pay all of your medical costs. They may even offer to pay for your lost wages. Again, this sounds so good and is a tempting offer; however, in return the insurance company will require a full release of all claims arising out of the accident. What you may not know is that Colorado Law allows you to recover for much more than just your past medical costs and your past lost wages. You may be able to recover additional compensation for future wages (not just lost wages), lifestyle changes, or pain and suffering damages.
What every person needs to know is this: Colorado Law protects people who have been injured by the negligence of fellow drivers. There is a long-standing system in place designed to award you the compensation you deserve.
It is important that you trust that system. It can and does get overwhelming, especially for those unaccustomed to dealing with it. But, with a little patience, and an experienced attorney fighting for you, most victims receive the compensation they need and deserve.
